^Took him long enough. The thought over at TFL is that the instant Judge Scullin signed his name to the order, DC went Constitutional Carry.

It's suspected that DC will appeal, and of course ask for a stay... might not be granted though. Big day for gun owners.

An even more important follow-on is that the first place they can appeal is the DC Circuit Court, which gave us the Heller win. If we win there, it's unlikely to be picked up by SCOTUS.

The language in the decision is very strong:
“enjoins Defendants from enforcing the home limitations of [D.C. firearms laws] unless and until such time as the District of Columbia adopts a licensing mechanism consistent with constitutional standards enabling people to exercise their Second Amendment right to bear arms.”

samnavy 07-28-2014 08:33 AM

I guess it's pretty much official. DC is now Constitutional Carry. The Chief of Police came out and said that, for now, nobody would be arrested for carrying if they could legally own a gun. Of course there is still a ban on magazines over 10rds... and of course, no .50BMG.

Emily Miller is going on Fox at 8am to spell it all out.

Gun laws in the District of Columbia - Wikipedia, the free encyclopedia

In addition to the long list of reasons to restrict magazine capacity limits, I always like to talk about the fact they basically make it pretty dumb not to use the largest caliber you can. Srsly, if I'm limited to 10rds in a full-size or even compact'ish handgun, why wouldn't I just go with 10mm or .45+P's... if I can only have 10, then the "size vs. capacity" argument goes out the window and you're just left with "go big or go home". I don't know how you could intentionally choose 9mm over .45 if you were going to carry a gun that could hold the same amount of ammo? Or even .40?

cop doesnt know his state's open carry laws, asks citizen for help

Braineack 07-30-2014 08:59 AM

informed citizen wins.

i absolutely love it when police, while wielding a firearm, try to argue for other's safety when it comes to a citizen carrying their own.

Pen2_the_penguin 07-30-2014 01:58 PM

I love how he was armed with a AR the whole time behind the car door while trying to cite BS abooooot the safety of citizens.

Braineack 07-31-2014 10:04 AM

more logic.

i wonder how police will feel if citizens start drawing weapons on police when they see them legally carrying...

recurring theme: how consistently convienient from them.

Video capturing moment APD officer shot Armand Martin may not exist | KOB.com

“This is predictable and this is precisely what the Department of Justice report says on pages 35 and 36 that in particular SWAT at APD almost routinely fails to capture video of all of their engagements,” said Correia.

...

APD also said Officer Hughes was was acting as a cover officer when he shot Martin and was not required to wear a helmet in that capacity.

Correia also finds that concerning.

“If this is true then the Albuquerque Police Department should have put lapel cameras on everybody and helmet camera videos on everybody,” he said.

APD said its officers were either too far away to capture the shooting, taking cover behind armored vehicles, or didn’t have their body worn camera pointed at the front of the house where martin was shot

“There's no way no for us to evaluate whether or not Armand Martin was a threat, because there's no lapel camera video,” said Correia.

Police respond to report of gun, Northampton man tells officers only 'guns' present are his biceps | masslive.com

City police were called to a North Maple Street home Monday afternoon, responding to a report of a man with a gun.

When asked by police if he was in possession of any weapons, the resident responded that the only "guns" present were his biceps, the Daily Hampshire Gazette reports. Then the man proceeded to flex his muscles for the officers.

A search of the North Maple Street home produced no guns except for a toy water gun.

What the actual fuck:

A search of the North Maple Street home...
I don't understand this. On what grounds was the home searched?

Braineack 08-01-2014 12:08 PM

oh you didn't know?

since it's perfectly legal to own, possess, and carry a firearm in NH without a license, the police needed to make sure that ughhh, uhhh, hmmm, that you're following the state motto: live free or die...oh wait no...don't worry, we'll figure one out.

dieselmiata 08-01-2014 12:11 PM

I know!

They "smelled pot".

Braineack 08-01-2014 12:31 PM

oh yes! thank you.

I'm going to strap my GoPro to my chest, sit on my front porch and clean my AR15 this weekend. I live 4 blocks from the police station and 6 blocks from the county seat.

How much you want to bet I meet the SWAT team on Saturday?

Hopefully you see them before there is a hole in your chest.

Braineack 08-01-2014 01:25 PM

will you show them your "guns"?

I would be willing to bet that the search was voluntary.

"Well, Sir, do you mind if we search your home?"

"I don't have anything illegal, come on in."

Braineack 08-01-2014 02:11 PM

yup, they'll take every advantage of that.

cause one day they'll get lucky and bust a drug dealer and then finally make detective after 20 years on the force in the same low-level position.

EO2K 08-01-2014 03:38 PM

I'll consider this after I get into my own place. I don't need my landlady evicting me at the moment.

I'll hear them coming, they are in no way stealthy and I have excellent lines of sight :giggle: I'd figure out a way to live stream it for ya'll.

All it takes is one.

They are TRAINED to take advantage of that. "Do you mind if I come in?" "is it OK if I search your car?" People are stupid as hell and think that just because a cop asks you something you have to say yes.

police create crime to arrest this open carry activist:

Did Phoenix Airport Police Arrest An AR-15 Open Carrier Without Reason? [Video] - Bearing Arms

claim he pointed his AR15 at two people, video clearly shows that's not the case, charges mysteriously were dropped.
